Medical marijuana was legalized in Mississippi in Feb. 2022 after a back and forth with the state’s Supreme Court over a technicality in the law voted in by Mississippi residents in 2020. Recreational marijuana remains illegal for now.

- Possession of fewer than 30 grams will not result in jail time; however, there is a maximum fine of 250 USD.
- Selling up to 30 grams of marijuana is a felony punishable by up to 3 years imprisonment and a maximum fine of 3,000 USD.
- Cultivation in Mississippi will be punished based upon the aggregate weight of the plants found.
- Using or possessing paraphernalia is a misdemeanor, punishable by up to six months in jail and a maximum fine of 500 USD.
- Any conviction will result in a driver’s license suspension for six months.

How to get a medical marijuana card in Mississippi

2020: The Medical Marijuana campaign gathered 228,000 signatures to place Initiative 65 on the ballot to legalize two and a half ounces of cannabis every two weeks for medical patients.
To legalize medical cannabis, it would have to be from a state-licensed treatment center, and there is a fine for public use.
2021: the Mississippi State Supreme Court invalidated Initiative 65 from legalizing medical marijuana based on a minor technicality in the state initiative law.
2022: Governor Tate Reeves signed the Mississippi Medical Cannabis Act into law to legalize medical marijuana on Feb. 2, 2022. Per the new Medical Cannabis Law and the Mississippi Department of Health, the medical program should be fully functional for cannabis patients later in the year.
